Terms of Service


These Terms of Service have last been updated 1st April 2021.

Thank you for using Smappy!

By using the Services, you agree to be bound by these Terms and acknowledge and agree to the collection, use and disclosure of your personal information in accordance with Smappy’s Privacy Policy.

1. Definitions

  • “Smappy”, means Smappy application Oy, Lapinlahdenkatu 16, 00180 Helsinki, Finland, business ID: 3130335-4
  • “Smappy App”, means a digital application called Smappy App provided by Smappy for natural and legal persons to order products from Smappy retailers.
  • “Smappy Delivery Courier”, means natural and legal persons who pick your order in-store, if available, and deliver your eligible order to your location.
  • “Smappy Delivery App”, means a digital application called Smappy Delivery App provided by Smappy for Smappy Delivery Heroes.
  • “User” or “you” means a natural person using the Smappy Service.

2. Identity of Smappy

  • “Smappy” is a retail and IT ecosystem that comprises Smappy App, Smappy Delivery App and Smappy Brands portal.

3. Description of Smappy Service

The Services comprise a retail application that comprises the following features:

(i) “My Shop” - A set of one or more virtual stores (retailers) from which you can purchase products for delivery to your location by our Smappy Delivery Heroes, or, if available, for you to pick up in-store.

(ii) “Discounts” - Find all the discounts from multiple stores in one place. The discounted products can only be purchased in-store.

(iii) “Manage Lists” and “Family & Friends” - Create grocery shopping list that you can use upon your grocery shopping in-store, or, purchase on the app for delivery, if eligible. In addition, you can share your grocery shopping lists with other Smappy users.

(iv) “My Favorites” - Save all your favorite product that you would want to purchase later.

(v) “Your Credit” - Smappy Credits allows you to use the non-spent money from your orders when, for instance, an item is not available in-store upon shopping by our Smappy Delivery Heroes. This feature allows you to use your credits on your next order or request a refund by bank transfer.

The use of the Smappy service is free of charge. However, using the Smappy Service for ordering products from Smappy will result in an obligation for payment. You agree to pay for all purchases arising from your use of the Smappy Service.

3. Your Use of the Services

The Smappy Service is only available to persons of the age of 18 years or older.

The Users shall be responsible for picking up electronic items at the store.

The User will not:

(i) use or attempt to use another person’s personal Smappy account and/or access another person’s personal payment data through the Smappy Service or use another person’s personal payment cards when using the Smappy Service, without consent of that other person;

(ii) copy, modify or create derivative works of the Smappy Service or any related technology;

(iii) reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Smappy Service or any related technology, or any part thereof;

(iv) remove any copyright, trademark or other proprietary rights notices contained in or on the Smappy Service;

(v) remove, cover or obscure any advertisement included on the Smappy Service;

(vi) collect, use, copy, or transfer any information obtained from the Smappy Service without the consent of Smappy;

(vii) use bots or other automated methods to use the Smappy Service;

(viii) create a Smappy account using a fake identity or an identity of another person; or

(ix) access the Smappy Service except through the interfaces expressly provided by Smappy, such as the Smappy App and Smappy Website.

4. Privacy Policy

User Data

User data is personal data collected directly from you or from our customer organization on behalf of which you are using the Smappy Services. We may collect user data from our users and customer in a variety of ways, including, after users register to the Smappy Services, subscribe to a newsletter or fill out a form. Further, please note that we also collect details of any transactions and payments you carry out through the Smappy Services.

The following personal data collected and processed by us is necessary in order for a proper performance of the contract between you and us.

When you register to the Smappy Services and create a user account, you need to provide us with the following information:

(i) full name

(ii) telephone number

(iii) email address

(iv) information relating to your payment instrument(s) such as the number of your payment instrument(s) and the expiration date of your payment instrument(s) (required for the purposes of ordering food products via the Smappy Services, however not stored by Smappy, since Smappy uses a third party payment service provider for processing of payments)

Analytics Data

We may automatically collect the following Analytics Data when you visit or interact with the Smappy Services:

Device Information. We collect the following information relating to the technical device you use when using the Smappy Services:

(i) device and device identification number, device IMEI

(ii) country

(iii) IP address

(iv) browser type and version

(v) operating system

(vi) Internet service providers

(vii) advertising identifier of your device

(viii) visitor identifier

Usage Information. We collect information on your use of the Smappy Services, such as:

(i) time spent on the Smappy Services

(ii) interaction with the Smappy Services

(iii) information on your orders made through the Smappy Services

(iv) the URL of the website you visited before and after visiting the Smappy Services

(v) the time and date of your visits to the Smappy Services

(vi) the sections of the Smappy Services you visited

(vii) the products you searched for while using the Smappy Services

Cookies

We use various technologies to collect and store analytics data and other information when the Users visit the Smappy Services, including cookies and web beacons.

Cookies are small text files sent and saved on your device that allows us to identify visitors of the Smappy Services and facilitate the use of the Smappy Services and to create aggregate information of our visitors. This helps us to improve the Smappy Services and better serve our users. The cookies will not harm your device or files. We use cookies to tailor the Smappy Services and the information we provide in accordance with the individual interests of our users.

Please note that some parts of the Smappy Services may not function properly if use of cookies is refused.

Smappy Voucher

Smappy Voucher are given by Smappy by XX to help you save money on the products you love.

Payment

Smappy allows customers in Finland to pay for in-app orders of eligible items from selected retailers by using relevant online payment methods provided in the Smappy Service.

Delivery Service Complaints

If there are any defects in the delivery of the order, you may contact our customer service through the in-app customer support chat or at XXX.

Return and cancellation policy

After the order has been placed by the user, the order cannot be cancelled by the user. You cannot withdraw or cancel an order for products or delivery services once you have placed it. Prior to placing an order for a product or service you should carefully review your selection.

Dispute Resolution

If you are a consumer, you can refer the disagreement to the Consumer Disputes Board:
